NOTE ON GUINEA’S INTERNATIONAL INVESTMENT COMMITMENTS
The Republic of Guinea has signed a number of agreements with other countries in the form of tax treaties (I), agreements on the mutual promotion and protection of investments (II) or sectorial cooperation agreements in specific sectors (III). These commitments are intended to promote investments and strengthen economic cooperation ties between the signatory states.

  1. Double taxation avoidance agreements and preventing tax evasion & combating fraud

The overall purpose of these agreements is to avoid double taxation of persons (natural or legal) receiving income in two (2) different countries. In particular, they define how the tax residence is determined, i.e. the place of taxation, to avoid the citizen or company from one country residing in another to pay tax separately in each country.
This will allow foreign investors to avoid being subject to double taxation on their income or profits from their work or investments in Guinea and in their country of origin.
It should however be noted that under these agreements, the taxes subject to double taxation avoidance are determined or specified. They are usually the income tax, corporate tax, payroll tax, non-commercial income tax, income from independent professions.
These agreements also allow the exchange of information between the signatory countries in order to prevent tax evasion and combat fraud.

  1. Agreements on the mutual promotion and protection of investment

Agreements on the mutual promotion and protection of investment greatly help in developing and strengthening long term economic and industrial cooperation between Guinea and the other signatory states. Particularly, they create favorable conditions for investments of either Contracting Party in the territory of the other Contracting Party.
They also help to protect the investments made in Guinea by investors from these signatory countries (and vice versa) and to stimulate the flow of investments and individual business initiatives with regard to promoting the economic prosperity of the Contracting Parties.

  1. Sectorial cooperation agreements

The objective of these cooperation agreements is to develop the sector of activity it covers.
Such agreements may exist between a public entity or a public service [1] of a country and its equivalent in another country. In so doing, they promote cooperation and help increase trade volume and develop economic, technical and social cooperation between companies from both countries in the areas covered.
